Questions

Common questions about international tax and transfer pricing

If your question is not here, ask us directly. We reply in plain language.

Does transfer pricing apply to small groups?

It applies to transactions between related parties whatever the size of the group, including those between a Kenyan company and its foreign parent or sister company. How much documentation you need can differ, so ask us to look at your transactions.

What happens if KRA disagrees with our prices?

KRA can adjust your taxable profit and charge tax, penalties and interest on the difference. Documentation prepared before an audit is your strongest defence.

We pay a foreign supplier for services. Do we withhold tax?

Often, yes. The rate depends on the type of payment and on whether Kenya has a tax treaty with the supplier’s country. We check each case.

Trading across borders?

Tell us which countries and which transactions are involved. We will tell you what documentation you need.
